How is Fault Determined in a New Jersey Car Accident?

In order to recover financially as a result of a car accident lawsuit, New Jersey law requires that you demonstrate that the driver of the other vehicle was negligent.  In order to do so, you must be able to show that the other driver had a duty to operate his or her vehicle in a safe manner and that he or she failed to abide by that duty.  You also need to make a connection between the other driver’s failure to act appropriately and your injury.  The third hurdle to overcome in order to collect money damages from a New Jersey car accident is to show that the injury you received was a result of the car accident.

The Car Accident Lawsuit Process in NJ

After your car accident, the first step in the lawsuit process is to meet with an attorney to discuss your rights, as well as the potential merits of your claim.  During the initial consultation, a preliminary determination needs to be made as to whether or not the driver of the other automobile appears to have been negligent.  During your initial consultation with your personal injury attorney, he or she will review the facts of the case with you and determine what steps need to be taken in order to properly pursue your claim.

These steps may include the hiring of a private investigator or accident reconstructionist to review the police report in detail, contacting any witnesses to obtain relevant statements, and visiting the site of the crash to determine if there were any deficiencies in the roadway that may have contributed to the cause of the accident.  After investigation, your New Jersey auto accident attorney will file a Complaint with the Superior Court of New Jersey seeking to obtain compensation for your injuries.

After the filing of the Complaint, the defendant is made aware of the claim, outlining your injuries and allegations.  The insurance for the other driver will typically respond by denying the allegations in the Complaint or contacting your attorney and attempting to enter settlement discussions.  In the event the settlement discussions do not result in an acceptable settlement, the parties then engage in what is called the discovery process.  During the discovery process, all relevant information, such as medical records, is exchanged, and depositions will be scheduled.

At the conclusion of the discovery process, additional settlement discussions may take place that may involve a mediator or the judge assigned to the case.  If an acceptable settlement offer is reached, the parties enter into a Stipulation of Settlement and the case is settled.  If the offer is not accepted, the case is then tried in court before a jury and the jury will decide what driver is at fault and what monetary amount, if any, should be awarded.
